1. Stock Availability
All products are offered subject to availability. While we make every effort to keep stock information accurate, we do not guarantee availability at the time of order.
2. Delivery Times
Delivery timeframes provided are estimates only and not guaranteed. Waterjet Parts Australia is not liable for delays caused by freight providers, customs, or other circumstances beyond our control.
3. Delivery & Freight
Freight is arranged on behalf of the customer, who may choose from available service levels (for example standard, express or overnight). Freight charges are payable by the customer unless otherwise agreed in writing.
Once goods are collected by the freight provider, risk passes to the customer. Waterjet Parts Australia is not responsible for courier performance, including delays, loss or damage in transit. Any claims arising from freight issues must be lodged directly with the freight provider.
Our responsibility is limited to dispatching the goods in good condition to the address supplied on the order.
4. Payment Terms
All orders are subject to manual invoicing. An order is not confirmed, and no goods will be dispatched until full payment of the issued invoice has been received.
Prices are subject to change prior to invoicing. Orders may be cancelled if payment is not received within the timeframe specified on the invoice.
5. Product Information & Compatibility
Descriptions, specifications and compatibility details, including OEM cross-references, are provided to the best of our knowledge and are intended as a general guide only.
All products supplied by Waterjet Parts Australia are aftermarket components and are not manufactured, authorised or endorsed by the original equipment manufacturers unless explicitly stated.
It is the customer’s responsibility to confirm compatibility with their specific waterjet machine and intended use. Customers must consult relevant operating manuals, OEM documentation or qualified technicians before installation.
Waterjet Parts Australia does not accept liability for incorrect part selection or for damage, downtime or costs arising from improper installation or use.
6. OEM Trademark Notice
All manufacturer names, machine names, part numbers and trademarks are used for identification and compatibility purposes only. They remain the property of their respective owners.
Waterjet Parts Australia is an independent aftermarket supplier and is not affiliated with or endorsed by any original equipment manufacturer unless explicitly stated.
7. Australian Consumer Law
Nothing in these Terms & Conditions is intended to exclude, restrict or modify any rights or remedies a customer may have under the Australian Consumer Law or any other applicable legislation which cannot be excluded.
Where goods are supplied to a consumer within the meaning of the Australian Consumer Law, the goods come with guarantees that cannot be excluded under that law.
If a product has a major failure, the customer is entitled to a replacement or refund and compensation for any other reasonably foreseeable loss or damage. If a product fails to be of acceptable quality and the failure does not amount to a major failure, the customer is entitled to have the goods repaired or replaced.
To the extent permitted by law, Waterjet Parts Australia’s liability for any breach of a non-excludable guarantee is limited, at our option, to the repair or replacement of the goods, or the cost of having the goods repaired or replaced.
8. Limitation of Liability
Waterjet Parts Australia shall not be liable for any indirect, incidental or consequential loss or damage, including but not limited to loss of production, downtime or loss of profits, arising out of or related to the supply, use or inability to use our products.
Our liability is strictly limited to the replacement of defective goods or refund of the purchase price, at our discretion, to the extent permitted by law.
9. Returns & Warranty
Returns will only be accepted if the product is unused, in original condition and in saleable packaging. Customers must notify Waterjet Parts Australia within 14 days of receipt to request a return.
Approved returns may be subject to a restocking fee and must be shipped at the customer’s expense unless the item is faulty.
Warranty is limited to the repair, replacement or refund of defective goods at our discretion. Warranty does not cover normal wear and tear, improper installation, misuse or operation outside recommended conditions.
Where applicable, manufacturer warranties may apply in addition to these terms.
10. Use of AI Chatbot
Our AI chatbot has been trained on a wide range of waterjet-related resources to assist customers. However, it may produce errors, incomplete information or outdated guidance.
It should be used as a general support tool only and not as a substitute for reviewing OEM manuals, technical documentation or consultation with a qualified technician.
Final responsibility for verifying part numbers, compatibility and installation instructions rests with the customer. Waterjet Parts Australia accepts no liability for any decisions, purchases or installations made solely on the basis of chatbot output.
Chatbot inputs may be logged for quality improvement, but no sensitive financial data is stored.
11. Force Majeure
Waterjet Parts Australia shall not be liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, labour disputes, pandemics, power outages, supply chain disruptions or government restrictions.
In such cases, obligations may be suspended without liability until the event has passed.
12. Amendments to Terms
Waterjet Parts Australia reserves the right to update or amend these terms and conditions at any time without prior notice. The version published on our website at the time of order will apply.
13. Governing Law
These terms and conditions are governed by the laws of Victoria, Australia. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Victoria.
